1. Introduction
Welcome to Pugali Digital, owned and operated by Pugali Digital, located in Tamil Nadu, India. These Terms and Conditions govern your access to and use of our online marketplace, services and website, www.pugalidigital.com (the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.
2. Acceptance of terms
You must agree to these Terms to use our services. If you do not agree, you must stop using the Platform and our services immediately.
3. Definitions
- Publisher: a user who offers space on their digital media for advertisements or content placements.
- Advertiser (Buyer): a user who wants to place advertisements or content on media owned by Publishers.
- Listing: an offer by a Publisher making their media space available for use by Advertisers.
- Order: an agreement between a Publisher and an Advertiser for the placement of content or advertisements.
4. User accounts
You need an account to access certain services on the Platform. You must provide accurate and complete information and keep your account details up to date. You are responsible for all activity under your account.
5. Services provided
Pugali Digital provides a platform where Publishers and Advertisers connect and transact. It supports the listing, discovery and booking of media space for digital marketing.
All transactions are conducted in [U.S. dollars (USD) / Indian rupees (INR)].
Our services include, but are not limited to:
- User accounts and profiles
- Communication channels between users
- Submitting Listings (for Publishers)
- Presenting and publishing Listings on the Platform (for Publishers)
- Adding articles
- Ordering articles
- Tools for creating or supplying content, where the Advertiser provides it
- Browsing Listings
- Placing Orders
- Managing Orders, including access to Order history
- Access to payment history
- Monitoring Order delivery and cooperation between users
- Handling complaints and cancellations
- External billing systems
- Managing additional users
- Newsletter access
6. Payments
Publishers set the prices for their Listings and services, which are shown on the Platform in [USD / INR].
Payments must be made through our approved methods: [credit and debit cards, UPI, PayPal and bank transfer].
Pugali Digital may charge a commission on transactions. This commission is included in the final price the Advertiser pays.
7. Refunds
Refunds are issued in the following cases:
- Order not completed: if an Order is not completed as agreed, the amount is returned to the buyer's wallet balance on the Platform.
- Dissatisfaction with a completed Order: if you are not satisfied with a completed Order (for example, incorrect anchor text or changes to the original content) and the Publisher refuses to fix it, we may refund the amount to your wallet balance.
- Confirmed Orders: once an Order is completed and confirmed by the buyer, no refund is available.
8. Buyer responsibilities and automatic acceptance
Buyers must review completed Orders within 7 calendar days after the Publisher marks them complete.
- When a Publisher marks an Order as completed, the buyer receives an email and the Order status changes to "Waiting for Buyer" in the buyer dashboard.
- If the buyer does not accept the Order, report an issue or contact support within the 7-day review period, the Platform accepts the Order automatically.
- Automatic acceptance confirms the Order as completed for operational and payout purposes.
- After automatic acceptance, the buyer cannot dispute completion only because they did not accept the Order manually during the review period.
Pugali Digital may review exceptional cases at its sole discretion.
9. Content guidelines
You must make sure that any content you provide or interact with does not break any law, infringe anyone's rights, or contain harmful or prohibited material. Pugali Digital may remove any content that violates these guidelines.
10. Rights and obligations
- Publishers must have the right to offer the media space they list, and must keep their Listings accurate and lawful.
- Advertisers are responsible for making sure their content is legal and meets the terms agreed in their Orders.
- All users are fully responsible for the consequences of publishing content that breaks the law or infringes third-party rights. Pugali Digital is not responsible for such violations.
11. Privacy and data protection
Pugali Digital respects your privacy. Our Privacy Policy explains how we collect, use and protect your personal information.
12. Changes to these terms
Pugali Digital may change these Terms at any time. We will notify users of changes, which take effect as soon as they are posted on the Platform.
13. Disclaimer and limitation of liability
The Platform and our services are provided "as is", without any warranties, express or implied. To the extent permitted by law, Pugali Digital is not liable for any direct, indirect, incidental or consequential damages arising from your use of the Platform.
We do not guarantee the continuous operation of, or access to, any website. Nor do we guarantee that links stay in place, that traffic stays consistent, or that websites stay indexed by search engines such as Google.
Changes to search engine algorithms, website ownership or web content that affect rankings and visibility are outside our control. You accept that site outages, traffic changes and deindexing are inherent risks of digital marketing and SEO, which Pugali Digital cannot influence.
14. Governing law and jurisdiction
These Terms are governed by the laws of India. Any dispute arising from these Terms or your use of the Platform is subject to the exclusive jurisdiction of the courts in [city], Tamil Nadu.
